Scott County sheriff reminds public to check sex offender registry ahead of Halloween

BENTON, Mo., (KBSI) – As Halloween celebrations begin, the Scott County Sheriff’s Office is reminding residents to stay safe and informed regarding state laws and safety precautions.
Under Missouri law (RSMo §589.426), individuals required to register as sex offenders must follow specific restrictions on October 31 between 5 p.m. and 10:30 p.m. Those restrictions include:
Remaining inside their residence unless there is just cause, such as work or a medical emergency.
Avoiding all Halloween-related contact with children.
Keeping exterior residential lights turned off during the designated hours.
The Sheriff’s Office noted that a federal court ruling has suspended enforcement of the law’s previous requirement for sex offenders to post a sign stating, “No candy or treats at this residence.” The U.S. District Court ruled the sign requirement unconstitutional under the First Amendment in Sanderson v. Bailey (Oct. 2, 2024). The State has appealed, and oral arguments were heard in September 2025.
