Missouri judge rules Witness Name Redaction Law unconstitutional

JEFFERSON CITY, Mo. — A Missouri law requiring blanket redactions of witness and victim names in court filings has been deemed unconstitutional and unenforceable by a judge.

Cole County Circuit Court Judge Aaron Martin ruled in favor of the Missouri Broadcasters Association and its co-plaintiffs, who argued the law violated the First Amendment and the Missouri Constitution’s “Open Courts” provision.

“This isn’t just a win for journalists and lawyers; it’s a win for every Missourian and everyone interested in government transparency,” said Chad Mahoney, president and CEO of the Missouri Broadcasters Association.

The law, passed in 2023, mandated the redaction of witness and victim names from court filings, making it difficult for journalists to report on court proceedings.

The court’s ruling restores transparency to Missouri court filings, allowing journalists and citizens to access information on court cases.

The lawsuit challenged the law on multiple grounds, including its impact on free speech and open courts.

While the court rejected some claims, it ruled in favor of the plaintiffs on federal and state constitutional challenges.
